Terms of Service

These Terms of Service ("Terms") govern your use of the Club 22 mobile application ("App") operated by Top 22 Picks, LLC ("we," "us," or "our"). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the App. By creating an account, you represent that you meet this age requirement.

2. Account

You are responsible for maintaining the security of your account. You must provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to:

• Provide accurate scores and gameplay data
• Not manipulate GPS data or use location spoofing
• Not create multiple accounts to gain unfair advantages
• Not harass, abuse, or threaten other users
• Not exploit bugs or vulnerabilities in the App
• Comply with all applicable laws

We reserve the right to invalidate claims, suspend accounts, or take other action against users who violate these rules.

4. Gameplay and Territories

• Territory ownership is determined by gameplay mechanics including claim strength, score, and verification
• We reserve the right to modify gameplay mechanics, scoring algorithms, and territory rules at any time
• Territory ownership and leaderboard positions carry no monetary value
• Admin operators may invalidate claims that are determined to be fraudulent or in violation of these Terms

5. In-App Purchases

• Blitz multiplier purchases are processed through the Apple App Store or Google Play Store
• All purchases are subject to the respective store's terms and refund policies
• Blitz multipliers are consumed upon use and are non-transferable
• We reserve the right to modify pricing and availability of in-app purchases

6. User Content

By uploading a profile photo or other content, you grant us a non-exclusive, worldwide license to display that content within the App for the purpose of providing the service. You retain ownership of your content.

You are responsible for ensuring you have the right to upload any content you submit.

7. Group Verification

When participating in group verification, you agree to honestly confirm or dispute the scores of other players. Deliberately providing false verifications may result in account action.

8. Third-Party Services

The App integrates with third-party services including Firebase, Mapbox, and optionally Top 22 Picks. Your use of these services is subject to their respective terms and privacy policies.

9. Intellectual Property

The App, its design, features, and content (excluding user-generated content) are owned by Top 22 Picks, LLC. You may not copy, modify, distribute, or reverse engineer any part of the App.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee:

• Continuous, uninterrupted access to the App
• Accuracy of GPS verification or scoring calculations
• Availability of specific features or courses
• That the App will be free of errors or bugs

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may stop using the App at any time.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
